Section 15
Pension or Gratuity
(1) If a person who has completed twenty years of service in the post of Secretary General or Secretary, or if a person who is or has been appointed to the post of Secretary General or Secretary retires from service, adding the previous service period and the period of service in the post of Secretary General or Secretary, twenty years or If the service period is more than that, he will get a monthly pension calculated as follows:- Total years of service X monthly salary 50 Explanation: For the purpose of this sub-section, "period of working in government service" means the period of working in a post for which he can get pension from the Government of Nepal. will indicate.
(2) If the service period of the General Secretary or the Secretary does not reach twenty years, the General Secretary or the Secretary shall receive gratuity at the following rate upon leaving office:-
(a) Last half month's pay for each year of service in case of five to ten years of service,
(b) last one month's salary for each year of service if he has served for fifteen years in excess of ten years,
(c) If he has served for more than fifteen years but less than twenty years, the salary of the last one and a half months for each year of his service.
(3) If a person who has received gratuity for serving the Government of Nepal is appointed to the position of Secretary General or Secretary, only if he returns the full amount of gratuity received within one year of his appointment, his previous service period will be counted for the purpose of pension.
(4) When the general secretary's or secretary's salary is increased, two-thirds of the amount of the increase in the forfeited salary will be added to the pension of the general secretary and secretary who are receiving pension.
(5) If a person who is receiving pension due to serving the Government of Nepal is appointed to the post of Secretary General or Secretary and can also receive pension according to this Act, he/she will be allowed to choose one of the pension received before and according to this Act.
(6) Notwithstanding anything written elsewhere in this section, the general secretary or secretary who has been relieved from office on the basis of clauses (d) and (e) of section 6 of this act shall not be entitled to the benefits of pension or gratuity under this act.
